The General Data Protection Regulation (GDPR) of the European Union (EU 2016/679) applies to the processing of personal data by the Finnish Border Guard in situations where the Act on the Processing of Personal Data in Criminal Matters and in Connection with Maintaining National Security (1054/2018) does not apply. In addition to the GDPR, the Data Protection Act (1050/2018) is applied in a more detailed and supplementary manner. The Act on the Processing of Personal Data by the Border Guard (639/2019) also applies personal data is processed to perform the statutory duties of the Finnish Border Guard. Provisions on the Maritime Search and Rescue Register are laid down in the Maritime Search and Rescue Act (1145/2001). Provisions on the case management system for immigration affairs and the national Visa Information System (VIS) are laid down in the Act on the Processing of Personal Data in the Immigration Administration (615/2020).

The Act on the Processing of Personal Data in Criminal Matters and in Connection with Maintaining National Security applies to the processing of personal data by the Finnish Border Guard when personal data is processed for the purposes of preventing, detecting or investigating criminal offences or referring them for consideration of charges, safeguarding against and preventing threats to public security, protecting national security, and in military administration of justice. In this case, the Act on the Processing of Personal Data by the Border Guard also applies. 

As a rule, official documents are public. The Act on the Openness of Government Activities (621/1999) and other acts contain provisions on the conditions governing access to official documents.
